What if the dead players were Mafia? Then they would protect their own wouldn't they?

 

But that adds an element as well. If the 1 Mafia among the 3 can convince the other 2 to vote for a citizen, then he's helping out, no? Living mafias can steer lynching discussions towards helping their own, no reason for dead mafias to not get the chance to do so.

For that reason as well, I'd initially suggested that Marty doesn't take part as a Jury, since then he'll know who's the mafia and who's not. In fact, even in its current iteration I'd advise against Marty being a jury, since he already knew the roles beforehand, so though not likely, there's still a possibility of arguing against one or other side subconsciously.
